Terms and Conditions

These Terms and Conditions, together with our Privacy Policy and any other information provided prior to booking, govern your contract with Nomaya Surf House SARL, located at Rue Tisaliouine, Tamraght, Agadir, Morocco (Fiscal Number:40130170). Please read carefully as these define your and our rights and responsibilities.

By confirming a booking, the lead guest (the person making the reservation) agrees on behalf of all guests listed to these conditions and confirms they have authority to do so.

1. Contractual Agreement and Booking :
‍Your booking contract is with Nomaya Surf House SARL.
For group bookings, the lead guest is responsible for ensuring all group members understand and accept these terms and for payment of the entire booking, including any additional charges. No contract exists until we receive your completed booking form and the required deposit. We reserve the right to decline bookings at our discretion without explanation. Please verify booking details carefully and notify us immediately if you find any errors.

2. Pricing and Payment :
‍All prices are quoted in Euros (€), per person per week (7 nights) unless otherwise specified. Bed & Breakfast pricing is per night. Prices may vary due to changes in service fees, exchange rates, or insurance/security costs. Once booked, prices are fixed unless exceptional circumstances apply. A non-refundable deposit of 40% of the total booking cost is required within 14 days of reservation to confirm your booking. Failure to pay on time may result in cancellation. The remaining balance must be paid upon check-in, either in cash (Euros or Moroccan Dirhams) or by card. For bookings made less than 4 weeks before arrival, full payment is due immediately.

3. Cancellation Policy :
‍All cancellations must be sent by email to nomayasurfhouse@gmail.com immediately. Refunds depend on timing as follows:
Cancellation Notice Period Refund Amount :
- More than 30 days before arrival 100% refund
- 30 to 16 days before arrival 50% refund
- 15 to 8 days before arrival 25% refund
- Less than 8 days before arrival No refund
- No-show No refund
- Any unused services or shortened stays after arrival are non-refundable.

We reserve the right to cancel your booking, but except in cases of force majeure (e.g., natural disasters, political unrest, strikes), we will not cancel less than 8 weeks before arrival. In the event of cancellation by us, you will receive a full refund or an offer of an alternative holiday of similar standard.

4. Transfers and Transportation :
Airport transfers may be shared with other guests arriving or departing on different flights, possibly involving waiting times up to 60 minutes.
Departure transfers require guests to leave the accommodation at least 3 hours before their scheduled flight.
Transfers for stays of 7 nights or more are complimentary; shorter stays may incur additional charges.
Transfers not arranged by Nomaya Surf House are the responsibility of the guest and outside our liability.

5. Surf Guiding and Activities :
‍Surf guiding is offered to accompany you to local surf spots and provide general advice but is not surf instruction. Guests must be competent surfers capable of independent surf management.
Guides are not responsible for accidents or injuries incurred during surfing or other activities.
Alternative activities may be available during poor surf conditions but are subject to additional fees and availability.

6. Insurance and Liability :
‍Full travel insurance, including medical, accident, and personal belongings coverage, is mandatory for all guests.
Nomaya Surf House accepts no liability for injury, loss, theft, or damage to persons or property during your stay.
Guests must ensure they have adequate fitness and swimming ability to participate safely in surf-related activities.
Medical expenses incurred are the responsibility of the guest.
Guests are liable for any damage or loss of equipment provided by Nomaya Surf House. Optional equipment insurance is available for €40 per week, covering boards, wetsuits, fins, and leashes.

7. Equipment Insurance :
Surf equipment insurance can be purchased for €40 per week (€6 per day).
Without insurance, guests are responsible for repair costs or up to 50% of replacement value in case of damage or loss (typically between €100–€500).

8. Health, Fitness, and Travel Documents :
Guests must have a valid passport (minimum 6 months validity beyond departure date) and any required visas for Morocco.
It is your responsibility to seek medical advice before traveling and to ensure you are fit to participate in surf and retreat activities.
Nomaya Surf House may request medical certificates in special cases.

9. Conduct and Termination of Stay :
Guests must behave responsibly and respectfully toward other guests, staff, and property.
We reserve the right to terminate your stay without refund if your behavior threatens safety, damages property, or disrupts others. You will be responsible for any damage costs.

10. Excursions and External Activities :
Excursions are optional and priced separately.
Refunds for excursions apply only if the excursion is cancelled by us due to unforeseen circumstances or insufficient participants.
Nomaya Surf House is not responsible for activities or incidents outside the property or organized by third parties.

11. Animals :
Bringing street animals or animal food into Nomaya Surf House is strictly prohibited. Violation may result in immediate eviction without refund and liability for damages.

12. Governing Law and Disputes :
These Terms and Conditions are governed by Moroccan law.
Any disputes shall be subject to the jurisdiction of Moroccan courts.

13. Complaints Procedure :
‍Any issues during your stay must be reported immediately to Nomaya Surf House staff to allow prompt resolution.
Complaints not resolved locally should be submitted in writing within 28 days of departure.
Claims made after this period may not be accepted.
